The big question is however when are these conversational recordings legal or not?<\/p><p><\/p><p>Based on a publication done by Michalsons (a South African Law Firm),\u00a0different jurisdictions will give you\u00a0different answers, and surprisingly \u2013 in many cases\u00a0\u2013 recording without consent is legal.\u00a0This includes recording conversations over the phone or even someone speaking in a room full of people, without their consent to do so.<\/p><\/div>\n<\/div>\n<\/div>\n  <\/div>\n\n<div class=\"e2557-11 x-section\" >\n      \n<div class=\"e2557-12 x-container\" >\n    \n<div class=\"e2557-13 x-column x-sm x-1-1\" >\n    \n<div class=\"e2557-14 x-text\" >\n  <h3>Why Record Conversations?<\/h3><ul><li>Improve your customer service and satisfaction rates.<\/li><li>keep records for reference in case of any disputes.<\/li><li>review performance of call center staff.<\/li><li>improve sales process by reviewing sales conversations and\/or approaches.<\/li><\/ul><p>Whatever the reason for wanting to record your conversations,\u00a0as the saying goes - rather be safe than sorry. It's also a good practice to notify your callers where they are being recorded. Most customers could be unhappy when finding out at a later stage that their\u00a0conversation with you had been recorded.<\/p><h3>How the law handles recording without consent<\/h3><p>Recording without consent is unlawful, unless you fall under\u00a0the exceptions listed in the Regulation of Interception of Communications and Provision of Communication-Related Information Act (<a href=\"https:\/\/www.michalsons.com\/blog\/complying-with-rica\/1157\">RICA<\/a>). These exceptions include where you are a party to the communication, you have\u00a0the written consent of one of the parties to the communication, or the recording is in connection with the carrying on of business (in which case more specific requirements apply).\u00a0You are a\u00a0\u201c<em>party to the communication<\/em>\u201d if you are the sender, the recipient, or\u00a0any person included in\u00a0the communication (such as being copied in on an email).<\/p><blockquote><p>You do not need someone\u2019s consent when recording conversations if you are a party to the conversation<\/p><\/blockquote><h3>Add A Recording Notice For Your Caller<\/h3><p>Every Virtual Landlines Account comes with the ability to record both incoming and outgoing calls.
